AGAINST JUDICIAL CANDIDATE
DRAKE DELANOY

On October 29, 1998, the Standing Committee on Judicial Ethics and Election
Practices received a written complaint from the Honorable Gary Redmon against
Judicial Candidate Drake DeLanoy. Each candidate is seeking election as a
district court judge in Department 19 of the Eighth Judicial District Court.
Pursuant to the process established by the Standing Committee on Judicial Ethics
and Election Practices, a panel consisting of five members (two attorneys, to
non-attorneys and one non-voting judge) was chosen to evaluate the complaint and
determine if an unfair election practice had taken place. The members of the
panel were Mr. Art Besser, Janice J. Brown, Esq., Mrs. Joann Elston, the
Honorable Michael P. Gibbons, and Steven Wolfson, Esq. The panel was chaired by
Steven Wolfson, Esq.
Pursuant to Rule 4 of the rules adopted by the Nevada Supreme Court effective
December 1, 1997, and the Amendment thereto effective July 2, 1998, governing
the evaluation of such complaints, the Committee notified the complaining
candidate and the alleged defending candidate that a meeting would be held to
evaluate the complaint on October 29, 1998, at 1:00 p.m. in Las Vegas, Nevada.
Both candidates appeared with counsel and were permitted to present arguments,
evidence, briefs and authorities in support of their respective positions, and
the panel thereafter excused the candidates and discussed the complaint and
responses thereto.
In regard to the complaint filed against Judicial Candidate Drake DeLanoy
regarding the A-framed political signs, the Panel finds insufficient evidence
that Candidate DeLanoy has violated any judicial Canon.
Pursuant to Rule 4(4)(a)(i), the Committee has the authority to impose
sanctions, including publication of its decision.
The Panel finds that Judicial Candidate Drake DeLanoy did not violate any
judicial Canon relating to the A-framed political signs referenced above.
